Which procedure will apply?

In order to determine whether a movement of waste is possible, and where possible, which procedure should be applied, notifiers should refer to the following four criteria :
1. Waste origin
This refers to the country in which the caste was produced, and therefore the country from which it will be exported.
Please note : when submitting a notification, only one departure point may be entered for the waste (e.g. : the waste collection facility).
2. Destination and route to be taken
Here, notifiers must identify :
- in which country the waste will be processed
- whether or not the transfer will occur within the EU/EFTA/OECD regions
- if the route involves transit through other countries
Regarding the latter, it should be noted that waste originating in a French Overseas Territory (for example) and being brought into mainland France will be subject to :
– an informative procedure where there is no transit involved
– a notification procedure if the waste is to be transported (even without being transferred to another vehicle) through another country
3. Intended type of waste processing
Here, it must be determined whether or not the waste shipment is intended for :
- recovery or
- disposal

- non-hazardous waste : “Green list”
- hazardous waste : “Amber list”

NB : in cases where non-hazardous waste is being exported for recovery to non-OECD countries, parties should verify whether the destination country allows these types of transfers and what procedures will apply.
EC Regulation n° 1418/2007 of 29 November 2007 specifies restrictions and procedures to be applied based on responses issued by various countries.
