1. Basis
For all movements of waste subject to notification requirements, a contract must be drawn up between the notifier and the consignee regarding the recovery or disposal of the notified waste.
This document establishes the legal obligations of each party, particularly in the event that the movement is interrupted or carried out in an illegal fashion.
2. Required Information
The contract must always contain :
- the notification number
- the signatures of the notifier and consignee
- the active quantity of waste (requested by the Competent Authority in France for export files).
- the following regulatory elements :
- The contract shall be concluded and effective at the time of notification and for the duration of the shipment until a certificate is issued in accordance with Article 15(e), Article 16(e) or, where appropriate, Article 15(d).
- The notifier must take the waste back if the shipment or the recovery or disposal has not been completed as intended or if it has been effected as an illegal shipment, in accordance with Article 22 and Article 24, paragraph 2 ;
- The consignee must recover or dispose of the waste if this constitutes an illegal shipment, in accordance with Article 24, paragraph 3
- The facility must provide, in accordance with Article 16(e), a certificate that the waste has been recovered or disposed of, in accordance with the notification and the conditions specified therein and the requirements of this Regulation.
- If the notification involves one or more interim operations, the contract shall include the following additional obligations :
- the destination facility must provide, in accordance with Article 15(d) and, where appropriate, Article 15(e), the certificates showing that the waste has been recovered or disposed of in accordance with the notification and the conditions specified therein and the requirements of this Regulation
- the consignee must submit, where applicable, a notification to the initial competent authority of the initial country of dispatch in accordance with Article 15(f)(ii).
